Chapter 7 vs. Chapter 13 Bankruptcy

During the initial consultation we will review your financial situation and determine whether you qualify for Chapter 7 or Chapter 13 Bankruptcy. Chapter 7 bankruptcy is a liquidation bankruptcy where the trustee has the right to sell your nonexempt assets to pay your creditors. In the majority of circumstances, all of your assets can be protected using California Bankruptcy Exemptions. For example there is a $21,825 wild card protection (when there is no equity in the home or no home) in California which allows you to protect assets totaling $21,825, in addition to other protections. Most Chapter 7 bankruptcy cases are no asset cases where creditors receive nothing in the bankruptcy case and your debts are discharged.

Chapter 13 Bankruptcy is 36 to 60 month repayment plan in which creditors are paid a range from 0% to 100% of their debt. Most people will only pay back a small fraction of their total debt in a Chapter 13 bankruptcy.
